Can Sports Athletes Apply for the National Interest Waiver?

A National Interest Waiver (NIW) falls in the employment-based, second-preference (EB-2) immigration category. Generally, EB-2 petitions require a full-time job offer and an approved labor certification (so-called “LC”) from a U.S. employer. However, these requirements are waived for the NIW, thus allowing a petitioner/applicant to apply for a green card without a job offer or an approved labor certification from a U.S. employer. For the reasons, the NIW has received much attention from numerous foreigners who seek for permanent resident status in the U.S.

Over the past several years, a general misperception has developed about the NIW: many seem to think that it is only for people holding an advanced degree in a science-related field. It is true that the NIW is popular among people with at least a doctoral degree or professors in a science-related field. However, the NIW is not limited in scope and the only essential requirement of the NIW is to be able to contribute to the national interest of the U.S. For instance, sports athletes can also apply for the NIW.

Many of our firm’s NIW cases are on behalf of athletes. For example, one client was a football player in Korea. This client was a very popular football player in Korea’s local league. However, all his sporting activities were limited to local competitions and never at the World Cup or Olympic Games level. After his retirement, the client was a coach for a youth football team, and his team recorded a win at a small international competition. Upon retaining the client’s NIW case, our attorneys analyzed the American football market and discovered a very interesting fact.  Youth football in the U.S. was just as popular as basketball or American football, and interestingly, this popular youth football was not at all connected to adult football. We found many articles and columns stating that talented youths usually ended up in Europe to pursue further training and that America was in dire need of more football coaches. We were also able to confirm that the FIFA rankings of the U.S. had remained unchanged for many years. Based on this research, we analyzed the advantages of football, the potential of the U.S. football market, and the problems associated with the current shortage of coaches. Upon submitting the petition based on this research showing that the client would benefit the national interest should he be able to come to the U.S., the petition was approved. This is an example of a case where an NIW based on a field other than a science field can be approved, even without necessarily having international level experience such as the World Cup.

In addition, other types of athletes have been approved based on being part of a group that is much needed in the U.S. It is true that many sports are influenced by natural genetic factors in terms of strength and physique. As such, it may not be easy for Asians to win international competitions that are based on physique and strength such as bodybuilding. Another client we represented was a bodybuilder, and we analyzed the bodybuilding market. In the past several decades, most international competition winners were white or black, with very few winners being Asian. Our client had never won a major international competition, although he had won many competitions in Asia. We emphasized in his petition that if this person were to be actively involved in the U.S. competition scene, the American bodybuilding market, which to date was believed to be predominately white or black, would greatly benefit by being able to inspire and attract other races to the U.S. bodybuilding scene. We mentioned in the petition that pioneering people in various fields who were considered to be racially underrepresented were the ones who could help break down racial barriers. This case was also immediately approved.

The field of sports, just like the science field, is a field that can benefit from the NIW as well. Furthermore, it is not easy for an athlete to receive a job offer from a U.S. employer, which is required for a regular employment-based green card petition. As such, whether you are an international athlete or even a local athlete who has gained sufficient local recognition, the NIW is a viable option that should definitely be considered.
