Question: Do I have to attend to work related emails and/or phone calls outside working hours?

 

Answer:

 

Surely employees have received a work related phone call or an email during after hours. And every time this occurs, one may wonder if he/she has to answer the call or check his/her email. It is true that the nature of some occupations require continual communication via email or phone, but the time outside work to be spent with family and friends are precious and should not be disturbed. 

 

If you are an employee who receives phone calls or emails outside the working hours, depending on the occupational field, you may be eligible to receive overtime pay. 

 

The two main category of all employees are either Exempts or Non-Exempt. Exempt employees are not guaranteed minimum-wage or overtime pay but Non-Exempt employees are guaranteed minimum-wage and overtime pay. Often times, Exempt employees are company executives, administrators or professionals who can be classified as Exempt if they are guaranteed a salary above a certain level. This varies from company to company and almost all employees are classified as Non-Exempt.

 

If you are currently classified as a Non-Exempt employee, you are entitled to overtime pay. Even if you have been informed that you are not required to respond to a phone call or an email outside the working hours, you are entitled to overtime pay if your employer is aware of the response you have provided to the phone call and/or email outside the working hours. 

 

Keep in mind, that a simple phone call or email, once or twice, cannot be included in the overtime pay. However, continuous and consistent work outside the working hours is considered as an extension of working hours and should be paid overtime accordingly. 

 

If you have been attending to work outside the regular working hours and not compensated for such, you may report such violation to the Department of Labor Standard Enforcement.
