Parental Leave (Paid Family Leave)

Are you expecting a baby, or is there a sick family member who needs your care?

Currently, businesses with 50 or more employees are required to provide up to 12 weeks of unpaid leave under the Family and Medical Leave Act to eligible employees for qualifying events such as childbirth, baby bonding, and caregiving.

Federal law requires up to 12 weeks of unpaid leave for qualifying reasons; however, California state government requires up to 6 weeks of paid leave per eligibility. California government also requires employers to allow employees to take up to 4 months off for any disability related to pregnancy and childbirth regardless of eligibility for Paid Family Leave. 

Employees whose baby is due in four weeks or was born less than six weeks ago and who want to spend time with their newborns for bonding are eligible for paid leave. Also, those who welcomed a new child into the family in the past 12 months either through a partner’s pregnancy, adoption, or foster care are eligible for paid leave. Besides for welcoming a new child into the family, employees can request paid leave for caregiving of their sick family members.   

The amount of payments during Paid Family Leave is approximately 55% of wages during highest-paid calendar quarter in the prior year up to a maximum of $1,173 per week. Benefits are generally paid every other week.

If you request maternity leave for childbirth, you do not have to take all six weeks at once; however, it much all be used within one year.
